Just days after his 16th birthday in 2004, Joshua Matthew Davis was found fatally injured on the side of a road in Garner, North Carolina. Initially treated as a hit-and-run, the case quickly turned suspicious: no debris, no signs of struggle, and a head wound that suggested something more violent. Rumors swirled of past altercations and relationship drama, but despite early leads and even a false confession, the case went cold. Over two decades later, Josh’s family is still waiting for answers—and justice.

that we discuss and it really means a lot. So

00:01:19.200 --> 00:01:22.120
thank you. But with that, I think we should just

00:01:22.120 --> 00:01:25.739
go ahead and get into this week's case. We are

00:01:25.739 --> 00:01:30.140
on episode 129 this week and we are covering

00:01:30.140 --> 00:01:34.680
a cold case. Yep, cold case. And just as a quick

00:01:34.680 --> 00:01:37.319
content warning at the top, this case does involve

00:01:37.319 --> 00:01:41.700
a young person. Today, we are talking about the

00:01:41.700 --> 00:01:45.620
cold case of Joshua Matthew Davis. And this takes

00:01:45.620 --> 00:01:49.799
place in January of 2004 in Garner, North Carolina.

00:01:50.680 --> 00:01:54.620
But first, a little bit about Joshua. Joshua

00:01:54.620 --> 00:01:58.659
had just turned 16. His 16th birthday was a week

00:01:58.659 --> 00:02:03.219
before in December of 2003. He was a student

00:02:03.219 --> 00:02:05.680
at Gardner High School and was a popular kid

00:02:05.680 --> 00:02:09.400
there. Josh lived with his dad, but his mom is

00:02:09.400 --> 00:02:12.240
only a few blocks away, so he was able to walk

00:02:12.240 --> 00:02:14.580
back and forth between the two homes to see them.

00:02:14.860 --> 00:02:18.039
He spends a lot of time with his dad. They would

00:02:18.039 --> 00:02:21.180
ride dirt bikes and work out together. His dad

00:02:21.180 --> 00:02:24.360
admittedly spoiled him. As I mentioned before,

00:02:24.520 --> 00:02:27.400
Josh was well -liked at school. He was popular,

00:02:27.680 --> 00:02:31.229
especially amongst the girls. His family painted

00:02:31.229 --> 00:02:34.849
a picture that Josh was like a peacock. He was

00:02:34.849 --> 00:02:37.330
particular about his appearance and knew that

00:02:37.330 --> 00:02:40.669
he was popular. Our relatives of Joshua said,

00:02:40.830 --> 00:02:43.770
quote, a ladies' man, a legend in his own mind,

00:02:43.930 --> 00:02:47.210
end quote. For a period, he had a new girlfriend

00:02:47.210 --> 00:02:49.509
every month, and then he started dating somebody

00:02:49.509 --> 00:02:53.150
steady for around six months. Right before our

00:02:53.150 --> 00:02:55.689
timeline picks up, he had just broken up with

00:02:55.689 --> 00:02:57.930
his long -term girlfriend and had started dating

00:02:57.930 --> 00:03:01.099
a new girl. Also in the months leading up to

00:03:01.099 --> 00:03:03.520
the timeline, Josh and his friends would experience

00:03:03.520 --> 00:03:05.919
altercations with other people when they were

00:03:05.919 --> 00:03:09.020
out together. Him and his friends had been assaulted

00:03:09.020 --> 00:03:12.759
by people in a sport utility vehicle, and then

00:03:12.759 --> 00:03:15.740
there was another altercation at a Garner movie

00:03:15.740 --> 00:03:18.479
theater and they were chased by people in a car.

00:03:19.319 --> 00:03:23.979
And now a timeline of events. Tuesday, January

00:03:23.979 --> 00:03:28.740
6th, 2004. It's unclear exactly what Josh was

00:03:28.740 --> 00:03:31.360
up to during that day. Our timeline, however,

00:03:31.400 --> 00:03:34.560
picks up that evening of Tuesday, January 6th.

00:03:35.039 --> 00:03:38.240
Joshua and his 17 -year -old cousin Michael wanted

00:03:38.240 --> 00:03:40.860
to go play basketball at Joshua's dad's house.

00:03:41.219 --> 00:03:44.099
The house was close by, only a 10 -minute walk

00:03:44.099 --> 00:03:46.139
from where they were, so they set out around

00:03:46.139 --> 00:03:49.560
6 .45 p .m. Just a few minutes after leaving

00:03:49.560 --> 00:03:52.580
the house, Josh's cousin Michael realizes that

00:03:52.580 --> 00:03:54.800
he forgot a CD that he wanted to bring with him.

00:03:55.310 --> 00:03:57.469
He tells Josh to wait for him there and he'll

00:03:57.469 --> 00:03:59.689
run back to the house and grab it. They were

00:03:59.689 --> 00:04:01.610
still close to the house. They weren't even at

00:04:01.610 --> 00:04:03.990
the end of the road yet. Michael turns around

00:04:03.990 --> 00:04:06.629
and runs back to the house and leaves Josh standing

00:04:06.629 --> 00:04:10.050
there. When he returns just a few minutes later,

00:04:10.210 --> 00:04:13.030
he finds Josh laying on the ground, unconscious,

00:04:13.330 --> 00:04:16.089
on a bed of pine needles and bleeding from his

00:04:16.089 --> 00:04:19.329
head. Michael immediately runs to the house of

00:04:19.329 --> 00:04:22.250
the Andrews and bangs on their front door. When

00:04:22.250 --> 00:04:25.290
Daphne Andrews answers the door, She says, quote,

00:04:25.449 --> 00:04:29.089
he said, please call 911. I think my cousin has

00:04:29.089 --> 00:04:32.329
been hit by a car, end quote. And then Michael

00:04:32.329 --> 00:04:34.350
takes off running for the family home to get

00:04:34.350 --> 00:04:38.069
others. Josh's dad is also quickly alerted, and

00:04:38.069 --> 00:04:41.810
he walks over from his house. When his dad, David

00:04:41.810 --> 00:04:44.569
Davis, gets there, he sees Josh with a large

00:04:44.569 --> 00:04:48.189
wound above his ear. His dad says, quote, looked

00:04:48.189 --> 00:04:51.680
like he got hit upside the head, end quote. Josh

00:04:51.680 --> 00:04:53.939
is rushed to the hospital, where he will die

00:04:53.939 --> 00:04:57.879
from his injuries. Back at the scene, police

00:04:57.879 --> 00:05:00.879
are investigating it. Because Josh was found

00:05:00.879 --> 00:05:03.259
on the side of the road, they start working the

00:05:03.259 --> 00:05:06.500
case as a hit -and -run. But after taking a closer

00:05:06.500 --> 00:05:09.420
look at the evidence, or lack of evidence at

00:05:09.420 --> 00:05:12.120
the scene, police announce that it's a homicide

00:05:12.120 --> 00:05:21.639
investigation. Police say, quote, Everything

00:05:21.639 --> 00:05:24.240
was in an area that led us to believe something

00:05:24.240 --> 00:05:28.259
other than that occurred, end quote. So police

00:05:28.259 --> 00:05:30.959
believe, based on the evidence, that something

00:05:30.959 --> 00:05:33.720
else happened to Josh, not just a hit and run

00:05:33.720 --> 00:05:36.800
with a car. However, they also point out that

00:05:36.800 --> 00:05:38.800
there were no signs of a struggle at the scene.

00:05:39.360 --> 00:05:41.920
Police spend the rest of the evening combing

00:05:41.920 --> 00:05:45.100
the area. They bring in dogs to search to try

00:05:45.100 --> 00:05:47.860
to find any other evidence or even a murder weapon,

00:05:47.980 --> 00:05:50.100
but they're not able to find anything in the

00:05:50.100 --> 00:05:54.550
sweep. The next day, Wednesday, January 7th,

00:05:54.550 --> 00:05:57.250
police start talking to friends and family of

00:05:57.250 --> 00:06:00.529
Josh to learn more about him. It's here that

00:06:00.529 --> 00:06:03.209
police first start hearing rumors about boyfriend

00:06:03.209 --> 00:06:05.589
-girlfriend drama that Josh was involved in.

00:06:06.029 --> 00:06:09.689
In fact, police find a first round of suspects

00:06:09.689 --> 00:06:12.449
but quickly are able to eliminate them when they

00:06:12.449 --> 00:06:16.430
all have strong alibis. It's also during these

00:06:16.430 --> 00:06:19.009
interviews that a friend of Joshua's comes forward

00:06:19.009 --> 00:06:22.069
and says that he had a cell phone message on

00:06:22.069 --> 00:06:25.370
his phone from Josh's cell phone. There was no

00:06:25.370 --> 00:06:27.990
talking, but the friend heard what sounded like

00:06:27.990 --> 00:06:31.470
a struggle, footsteps, and moaning. However,

00:06:31.730 --> 00:06:34.350
the friend accidentally deleted the message before

00:06:34.350 --> 00:06:38.170
police are able to listen to it. On Thursday,

00:06:38.250 --> 00:06:42.310
January 8th, Josh was killed on Tuesday. Police

00:06:42.310 --> 00:06:44.769
still do not have any possible suspects at this

00:06:44.769 --> 00:06:47.529
point and are asking anyone that knew of any

00:06:47.529 --> 00:06:50.269
conflict that Joshua was involved in to please

00:06:50.269 --> 00:06:53.730
come forward. Police say, quote, we know about

00:06:53.730 --> 00:06:55.930
the boyfriend -girlfriend situation and we're

00:06:55.930 --> 00:07:00.509
looking into that, end quote. Police also reaffirm

00:07:00.509 --> 00:07:02.730
to the media that they believe it's a homicide.

00:07:03.350 --> 00:07:06.750
But they do leave open the possibility that perhaps

00:07:06.750 --> 00:07:10.050
a car with something sticking out of it hit Joshua.

00:07:10.800 --> 00:07:13.319
though they say that this scenario seems very

00:07:13.319 --> 00:07:16.980
unlikely. A memorial springs up in the area where

00:07:16.980 --> 00:07:20.540
Josh had been found. Notes left by friends, stuffed

00:07:20.540 --> 00:07:23.459
animals, and around 50 candles all mark the spot.

00:07:24.100 --> 00:07:26.379
Garner High School students leave notes for him,

00:07:26.519 --> 00:07:29.079
some reading, quote, I'm going to miss you always,

00:07:29.160 --> 00:07:32.199
and remember, you'll always be my husband, end

00:07:32.199 --> 00:07:35.819
quote. And another said, Heather, your hot mama,

00:07:36.079 --> 00:07:38.500
P .S., we'll make that picture of us together

00:07:38.500 --> 00:07:42.480
when we meet in heaven. The next day on Friday,

00:07:42.759 --> 00:07:45.439
just three days after his murder, and just a

00:07:45.439 --> 00:07:47.800
little over two weeks since his 16th birthday,

00:07:48.600 --> 00:07:52.160
Joshua is laid to rest. Police are still talking

00:07:52.160 --> 00:07:54.259
to his friends, and they also mention that they're

00:07:54.259 --> 00:07:56.740
looking into the incidents that happened prior

00:07:56.740 --> 00:07:59.480
to this, where Josh and his friends were chased

00:07:59.480 --> 00:08:02.139
by someone in a car and then assaulted by some

00:08:02.139 --> 00:08:05.680
people in a sports utility vehicle. On Wednesday,

00:08:05.800 --> 00:08:09.019
January 14th, So it's been over a week since

00:08:09.019 --> 00:08:11.759
Josh was found on the side of the road, and police,

00:08:11.899 --> 00:08:14.800
for the first time, go through his room and computer

00:08:14.800 --> 00:08:18.079
for evidence. His family is frustrated that it's

00:08:18.079 --> 00:08:20.199
taken police this long to look through his room.

00:08:20.800 --> 00:08:23.920
Lots of Josh's friends had come over to his dad's

00:08:23.920 --> 00:08:26.240
house after his funeral and had spent a lot of

00:08:26.240 --> 00:08:30.439
time in his room. His dad says, quote, any incriminating

00:08:30.439 --> 00:08:33.100
evidence that was in that room that would have

00:08:33.100 --> 00:08:35.679
incriminated anyone in that group is probably

00:08:35.679 --> 00:08:41.120
gone now. On Friday, January 16th, the medical

00:08:41.120 --> 00:08:44.799
examiner says that Joshua was likely killed by

00:08:44.799 --> 00:08:47.840
a moving vehicle. The medical examiner said that

00:08:47.840 --> 00:08:50.220
Joshua's hit at an angle above the right ear

00:08:50.220 --> 00:08:53.139
with, quote, a great deal of force, end quote.

00:08:53.320 --> 00:08:56.159
The hit peeled back tissue and fractured his

00:08:56.159 --> 00:08:59.679
skull in a radiating pattern. The medical examiner

00:08:59.679 --> 00:09:02.750
says, quote, To cause a fracture like that, it

00:09:02.750 --> 00:09:05.090
usually has to be a direct blow or something

00:09:05.090 --> 00:09:08.049
that is moving at a high rate of speed, end quote.

00:09:08.529 --> 00:09:10.730
The medical examiner believes that the impact

00:09:10.730 --> 00:09:13.870
resembles injuries with a car or, quote, possibly

00:09:13.870 --> 00:09:16.809
a side mirror or something hanging off or onto

00:09:16.809 --> 00:09:19.889
the vehicle, end quote. The medical examiner

00:09:19.889 --> 00:09:21.929
said that he spoke with others who agreed with

00:09:21.929 --> 00:09:25.110
his opinion, but he also acknowledges that he

00:09:25.110 --> 00:09:28.169
can't rule out that something else caused the

00:09:28.169 --> 00:09:31.960
blow. like a bat or something else rigid, and

00:09:31.960 --> 00:09:34.539
that the scene itself was not consistent with

00:09:34.539 --> 00:09:38.059
a car accident. The medical examiner says that

00:09:38.059 --> 00:09:41.200
police were left with, quote, with absolutely

00:09:41.200 --> 00:09:44.919
no evidence at the scene, end quote, which is

00:09:44.919 --> 00:09:47.580
unusual for a car accident. Normally there would

00:09:47.580 --> 00:09:50.139
be debris of some kind, paint transfer happening,

00:09:50.279 --> 00:09:54.039
but that was not found to be the case here. Police

00:09:54.039 --> 00:09:56.220
don't comment on the medical examiner's opinion.

00:09:56.960 --> 00:09:58.600
They just say that they have a very difficult

00:09:58.600 --> 00:10:00.759
case and they're still interviewing people in

00:10:00.759 --> 00:10:05.080
Josh's life. In the middle of February, so it's

00:10:05.080 --> 00:10:07.940
been over a month now since Josh was killed,

00:10:08.100 --> 00:10:11.019
and police arrest an 18 -year -old for lying

00:10:11.019 --> 00:10:14.720
to police about Joshua's case. The 18 -year -old

00:10:14.720 --> 00:10:17.220
is charged with one count of obstructing justice.

00:10:18.100 --> 00:10:21.059
Police say that the teen told police that he

00:10:21.059 --> 00:10:23.639
knew who killed Josh because he was there when

00:10:23.639 --> 00:10:26.649
it happened. He gave a written and oral statement

00:10:26.649 --> 00:10:29.649
to police that police were able to determine

00:10:29.649 --> 00:10:33.750
was a lie. The person that he accused of murdering

00:10:33.750 --> 00:10:37.169
Josh had no connection to him or the crime. Police

00:10:37.169 --> 00:10:39.309
are frustrated that they have gotten false information

00:10:39.309 --> 00:10:51.669
in this case. They say, quote, This kind of behavior,

00:10:51.909 --> 00:10:55.220
for whatever reason, is counterproductive and

00:10:55.220 --> 00:10:58.059
can result in criminal charges of persons willing

00:10:58.059 --> 00:11:01.340
to provide false or misleading information, end

00:11:01.340 --> 00:11:05.340
quote. In March of 2004, so it's been over two

00:11:05.340 --> 00:11:08.100
months since Josh's murder, and police release

00:11:08.100 --> 00:11:11.019
a composite sketch of a person who was seen close

00:11:11.019 --> 00:11:14.100
to where Joshua was found. The person was seen

00:11:14.100 --> 00:11:16.779
by several witnesses, quote, tripping over himself,

00:11:17.139 --> 00:11:20.279
end quote, as he ran away from the scene right

00:11:20.279 --> 00:11:22.559
about the time that Josh's body was discovered.

00:11:23.440 --> 00:11:26.120
Police would like to talk to the person. They

00:11:26.120 --> 00:11:28.740
describe him as being in his mid -teens to mid

00:11:28.740 --> 00:11:32.120
-twenties, broad in the shoulders, and had an

00:11:32.120 --> 00:11:35.379
athletic build. The suspect was wearing a white

00:11:35.379 --> 00:11:38.539
hooded sweatshirt, Carolina blue athletic pants

00:11:38.539 --> 00:11:41.120
with white stripes down both sides, and white

00:11:41.120 --> 00:11:45.340
tennis shoes. There are also rumors that a rival

00:11:45.340 --> 00:11:48.639
of Josh's at school rode by in a car and hit

00:11:48.639 --> 00:11:52.009
him with a baseball bat. That boy lawyered up

00:11:52.009 --> 00:11:54.389
and never spoke to police, according to Josh's

00:11:54.389 --> 00:11:58.509
dad. Despite the initial coverage and leads in

00:11:58.509 --> 00:12:01.549
the case, Joshua's case quickly falls out of

00:12:01.549 --> 00:12:04.370
the media and appears to go cold, though police

00:12:04.370 --> 00:12:07.610
are working on it in the background. Because

00:12:07.610 --> 00:12:11.129
in January of 2007, so it's been over three years

00:12:11.129 --> 00:12:13.929
since Josh was killed, and police say that they

00:12:13.929 --> 00:12:17.860
now believe that Josh was hit by a car. They

00:12:17.860 --> 00:12:20.320
say they hired a private firm to recreate the

00:12:20.320 --> 00:12:24.019
accident and the scenario was that most likely

00:12:24.019 --> 00:12:29.360
he was hit by a car. However, years later, when

00:12:29.360 --> 00:12:32.159
police and his family talk about the case, like

00:12:32.159 --> 00:12:37.000
in 2014 and 2018, there is no mention of it being

00:12:37.000 --> 00:12:39.600
a hit and run. There's no mention of a car being

00:12:39.600 --> 00:12:43.669
involved at all. Police say, in later years of

00:12:43.669 --> 00:12:46.610
2014 and 2018, that they're still trying to figure

00:12:46.610 --> 00:12:49.570
out what happened and list his cause of death

00:12:49.570 --> 00:12:53.110
as something hitting him in the head. The case

00:12:53.110 --> 00:12:56.909
today on the state police website lists his cause

00:12:56.909 --> 00:13:00.269
of death as a blow to the head. However, I think

00:13:00.269 --> 00:13:03.409
his mother sums it up perfectly. His mother says,

00:13:03.490 --> 00:13:16.690
quote, So with that, if you know anything about

00:13:16.690 --> 00:13:20.289
the murder of Joshua Davis in January of 2004,

00:13:20.830 --> 00:13:24.309
please call the Garner Police Department at 919

00:13:24.309 --> 00:13:30.750
-773 -6070. So that is the cold case of Joshua

00:13:30.750 --> 00:13:35.230
Davis. This is one of those cases where I immediately

00:13:35.230 --> 00:13:40.129
upon listening experience quite a bit of anxiety.

00:13:42.460 --> 00:13:46.139
mostly because of the way it almost seems he

00:13:46.139 --> 00:13:50.059
was blinked out of reality because of how quickly

00:13:50.059 --> 00:13:52.620
it happened. You know, his cousin stepped away.

00:13:52.899 --> 00:13:57.799
It was just a handful of minutes and he was hit

00:13:57.799 --> 00:14:03.779
and then he was gone. And with cases like these,

00:14:03.919 --> 00:14:09.080
I just, the questions can't come out of me fast

00:14:09.080 --> 00:14:14.850
enough the timeline and what was happening in

00:14:14.850 --> 00:14:19.590
that moment. So I'm very eager to cover and discuss

00:14:19.590 --> 00:14:24.149
this case. And just hearing about Josh in general,

00:14:24.330 --> 00:14:27.850
I don't know, most of us, I assume, listening

00:14:27.850 --> 00:14:30.090
have been to high school or in a high school

00:14:30.090 --> 00:14:32.950
environment, and there's always a boy like Josh.

00:14:34.509 --> 00:14:38.539
He sounded very sweet and like a lover boy. I

00:14:38.539 --> 00:14:40.179
liked hearing about him. I liked hearing that

00:14:40.179 --> 00:14:42.919
he had a good relationship with both of his parents,

00:14:43.000 --> 00:14:45.259
even though they weren't together anymore, that

00:14:45.259 --> 00:14:48.500
he had a strong relationship with his dad. I

00:14:48.500 --> 00:14:53.580
wish so more for him. Yeah. You know, I loved

00:14:53.580 --> 00:14:55.899
the description that Josh's family and friends

00:14:55.899 --> 00:15:00.279
gave of him. And it quite honestly reminded me

00:15:00.279 --> 00:15:03.340
a lot of my brother in high school. The way that

00:15:03.340 --> 00:15:05.659
Josh was described is exactly how I would have

00:15:05.659 --> 00:15:08.039
described my brother in high school, like a peacock

00:15:08.039 --> 00:15:11.259
walking around. And I, like you, when I came

00:15:11.259 --> 00:15:16.299
across Josh's case, the timeline of it brought

00:15:16.299 --> 00:15:18.240
up a lot of questions for me, which is really

00:15:18.240 --> 00:15:21.139
why I wanted to dig into the case and start researching

00:15:21.139 --> 00:15:23.080
it, because I just had so many questions myself.

00:15:23.259 --> 00:15:25.600
Because like you said, it's a very quick amount

00:15:25.600 --> 00:15:28.620
of time. I think his mother sums it up really

00:15:28.620 --> 00:15:31.070
great. I'm not quoting her exactly, but she says

00:15:31.070 --> 00:15:34.230
something along the lines of he left at 645 and

00:15:34.230 --> 00:15:37.610
he was dead by 705. Like that is really how quickly

00:15:37.610 --> 00:15:41.049
the time was in all of that. Yeah. So just jumping

00:15:41.049 --> 00:15:43.950
in here, this doesn't immediately correlate with

00:15:43.950 --> 00:15:47.490
his timeline. But to start at the top, I wanted

00:15:47.490 --> 00:15:51.789
to know what you made of the attacks slash chases

00:15:51.789 --> 00:15:57.490
by other school rivals. Yeah, that was an interesting

00:15:57.490 --> 00:16:00.080
piece that. didn't come up as much as I thought

00:16:00.080 --> 00:16:04.000
it would in my research, but I'm not sure if

00:16:04.000 --> 00:16:07.019
it is rivals from other schools or rivals within

00:16:07.019 --> 00:16:10.340
the schools. The people in these altercations,

00:16:10.360 --> 00:16:12.000
it's never clear if it's like other students

00:16:12.000 --> 00:16:16.580
or like adults or what exactly it was. But one

00:16:16.580 --> 00:16:19.399
question that I had around that was, did Josh

00:16:19.399 --> 00:16:22.500
like give the impression that these two incidents

00:16:22.500 --> 00:16:25.879
were the same people or did they seem to be caused

00:16:25.879 --> 00:16:30.269
by two different people? Separate groups. That's

00:16:30.269 --> 00:16:32.649
something that I question because to me, if they're

00:16:32.649 --> 00:16:35.289
the same people that I mean, that gives me a

00:16:35.289 --> 00:16:37.830
direction to like look at and investigate for

00:16:37.830 --> 00:16:40.909
sure. Yeah, I think it's absolutely something

00:16:40.909 --> 00:16:44.889
worth paying attention to. I'm glad that police

00:16:44.889 --> 00:16:47.809
did because in other cases we've covered before,

00:16:48.029 --> 00:16:52.389
they tend to not really listen to the kids or

00:16:52.389 --> 00:16:55.809
just chalk it up to regular teenage drama. And

00:16:55.809 --> 00:17:00.379
the fact that. He was someone who did have experience

00:17:00.379 --> 00:17:03.059
like pointed attacks on him or maybe his group

00:17:03.059 --> 00:17:05.059
of friends. I think it's worth paying attention

00:17:05.059 --> 00:17:07.960
to, especially in this case. Yeah, for sure.

00:17:08.000 --> 00:17:10.819
I'd love to know if anything came out of that,

00:17:10.880 --> 00:17:13.259
if they were able to pinpoint who the people

00:17:13.259 --> 00:17:16.579
were involved in those altercations or if they

00:17:16.579 --> 00:17:18.859
were ever able to get more information. Just

00:17:18.859 --> 00:17:21.500
getting back into the timeline a little bit,

00:17:21.599 --> 00:17:25.640
I'm curious to know what the terrain and road.

00:17:26.279 --> 00:17:30.740
looked like. I'm blanking on where you said this

00:17:30.740 --> 00:17:33.700
happened, so I couldn't even fill it in in my

00:17:33.700 --> 00:17:37.279
mind. So this happened in Garner, North Carolina.

00:17:37.480 --> 00:17:41.200
So in this area, tall, tall pine trees everywhere.

00:17:41.759 --> 00:17:45.059
The particular road where this happened. There

00:17:45.059 --> 00:17:47.880
are no sidewalks. So I thought that was something

00:17:47.880 --> 00:17:49.980
important to note when I was looking at Google

00:17:49.980 --> 00:17:52.579
Maps. No sidewalks in this area. So you would

00:17:52.579 --> 00:17:55.140
be walking next to the road kind of like in a

00:17:55.140 --> 00:17:59.559
ditch if you were walking along the road. But

00:17:59.559 --> 00:18:05.279
it does appear to be like more of a rural country

00:18:05.279 --> 00:18:08.380
road, but something with heavy traffic. Like

00:18:08.380 --> 00:18:10.000
even when I was looking at Google Maps, like

00:18:10.000 --> 00:18:12.220
there was constantly traffic and like even...

00:18:12.619 --> 00:18:14.680
I saw somebody like out walking a dog in Google

00:18:14.680 --> 00:18:17.059
Maps. So it's like it is a walkable area, it

00:18:17.059 --> 00:18:20.839
seems, but lots of traffic still. Thank you.

00:18:20.900 --> 00:18:24.019
And that makes sense to me. I mean, even if the

00:18:24.019 --> 00:18:27.619
city that you are living in itself isn't a rural

00:18:27.619 --> 00:18:30.759
area, there are lots of roads in big city spaces

00:18:30.759 --> 00:18:35.380
that appear that way just within a short space

00:18:35.380 --> 00:18:38.480
of time. I'm thinking of even roads in Chicago

00:18:38.480 --> 00:18:42.339
where we are that. Sometimes you'll round a corner

00:18:42.339 --> 00:18:46.960
and it is just a large stretch of tall trees

00:18:46.960 --> 00:18:50.880
where lots of cars are turning that corner. But

00:18:50.880 --> 00:18:56.299
that's really all there is happening. So really

00:18:56.299 --> 00:18:59.059
what I was trying to nail down was, is this a

00:18:59.059 --> 00:19:01.680
space where it wouldn't be visible to anyone

00:19:01.680 --> 00:19:05.000
else as the crime was happening? And I think

00:19:05.000 --> 00:19:07.809
that kind of answers my question that, yes. For

00:19:07.809 --> 00:19:10.829
this small moment of time, someone driving by,

00:19:10.950 --> 00:19:13.670
walking by, whatever it is that happened, they

00:19:13.670 --> 00:19:15.930
could get away with not being seen while doing

00:19:15.930 --> 00:19:19.150
it. Yeah, there are houses, you know, all along

00:19:19.150 --> 00:19:21.750
the street where Josh was found. But like you

00:19:21.750 --> 00:19:23.710
said, if somebody wasn't looking out the window

00:19:23.710 --> 00:19:27.529
or walking by or a car passing by, it would be

00:19:27.529 --> 00:19:30.990
easy to go unnoticed. And just to continue in

00:19:30.990 --> 00:19:33.329
the timeline as my questions were bubbling up,

00:19:33.569 --> 00:19:36.569
one of the first things I wrote down was, Was

00:19:36.569 --> 00:19:39.269
something thrown at him? And obviously you've

00:19:39.269 --> 00:19:42.710
covered that in tying the timeline together that

00:19:42.710 --> 00:19:46.390
there is probability there, but there's probability

00:19:46.390 --> 00:19:51.910
in a lot of different scenarios. So I'm glad

00:19:51.910 --> 00:19:55.970
that my mind is naturally asking the questions

00:19:55.970 --> 00:20:01.130
that law enforcement did to just pinpoint the

00:20:01.130 --> 00:20:04.710
area of where and or how this could have happened.

00:20:05.480 --> 00:20:10.480
Another question I had was, was he initially

00:20:10.480 --> 00:20:14.420
responding at all or was he after being hit,

00:20:14.460 --> 00:20:18.380
was he unconscious or just incapacitated? And

00:20:18.380 --> 00:20:20.859
I don't know if you know, but I'm just curious

00:20:20.859 --> 00:20:26.279
to know that information. So from my understanding

00:20:26.279 --> 00:20:28.579
and from everything I've read, it does seem like

00:20:28.579 --> 00:20:33.440
by the time his cousin gets back, he is unconscious

00:20:33.440 --> 00:20:37.960
and not. talking to anybody um or responding

00:20:37.960 --> 00:20:41.259
vocally in any way but there is that mention

00:20:41.259 --> 00:20:43.839
of like a phone call or like a voicemail left

00:20:43.839 --> 00:20:47.380
where that person said that he heard like moaning

00:20:47.380 --> 00:20:52.339
that was literally my next question and i don't

00:20:52.339 --> 00:20:54.859
really know what to make of it but what i wrote

00:20:54.859 --> 00:20:58.119
down was what do you make of that phone call

00:20:58.119 --> 00:21:02.460
i'm so sad that it doesn't exist anymore yeah

00:21:02.460 --> 00:21:07.900
i um It's one of those things I wonder. I have

00:21:07.900 --> 00:21:12.480
to think that the technology existed to retrieve

00:21:12.480 --> 00:21:17.440
deleted messages even in 2004, but maybe it didn't.

00:21:17.640 --> 00:21:21.839
But yeah, that voicemail. You know, did Josh

00:21:21.839 --> 00:21:24.680
have a cell phone on him when he was found? I

00:21:24.680 --> 00:21:27.019
think that's like a question that I have. It

00:21:27.019 --> 00:21:29.859
seems like there might have been one at the scene.

00:21:29.960 --> 00:21:32.079
It's mentioned a little bit in the beginning,

00:21:32.119 --> 00:21:34.200
but kind of falls out of the details throughout

00:21:34.200 --> 00:21:39.359
the years. Yeah, it's a hard case because we

00:21:39.359 --> 00:21:41.339
know that a lot of people came forward trying

00:21:41.339 --> 00:21:46.059
to be helpful or whatever, but gave false information.

00:21:49.049 --> 00:21:52.390
I would think in this case, you know, his friend

00:21:52.390 --> 00:21:55.170
wouldn't lie about hearing this thing. You know,

00:21:55.210 --> 00:21:56.970
the other case where we have somebody lying,

00:21:57.089 --> 00:21:58.630
it seems like they were trying to point the finger

00:21:58.630 --> 00:22:01.130
and get somebody in trouble. But there's no reason

00:22:01.130 --> 00:22:05.430
to lie about this message. So I am very curious

00:22:05.430 --> 00:22:08.730
about it. And I'd be interested if Josh did have

00:22:08.730 --> 00:22:11.910
a cell phone. So did that number dial this friend?

00:22:11.990 --> 00:22:14.960
I think it's easy to see. tell if this did happen.

00:22:15.180 --> 00:22:17.819
So I would just be curious what came of that

00:22:17.819 --> 00:22:20.660
because it's never mentioned again. Do you think

00:22:20.660 --> 00:22:24.519
that, and go with me here because I, again, I

00:22:24.519 --> 00:22:30.500
think this is speculation, but as if we're kind

00:22:30.500 --> 00:22:33.619
of navigating this case as if it was a hit and

00:22:33.619 --> 00:22:37.740
run or that it was a hit and run and or someone

00:22:37.740 --> 00:22:40.759
passing by him and causing a great impact to

00:22:40.759 --> 00:22:46.859
his head. Do you think that the timing of their

00:22:46.859 --> 00:22:50.380
walk was somehow coordinated? And by that, I

00:22:50.380 --> 00:22:54.319
mean, did someone know that they were going to

00:22:54.319 --> 00:22:58.059
be walking that section of the road? Did they

00:22:58.059 --> 00:23:01.740
know that his cousin was going to step away momentarily?

00:23:01.859 --> 00:23:07.039
Or if not, were they watching? That's kind of

00:23:07.039 --> 00:23:11.519
how I have filled in the details in my head.

00:23:12.109 --> 00:23:14.390
to make it possible for this crime to happen

00:23:14.390 --> 00:23:17.829
so quickly without anyone being there the moment

00:23:17.829 --> 00:23:21.849
his cousin walks back up to him. So I know there's

00:23:21.849 --> 00:23:23.630
a lot to expand on there, but I'm just curious

00:23:23.630 --> 00:23:26.690
to know what your thoughts are. The timing of

00:23:26.690 --> 00:23:32.029
it does feel really important. You know, if there

00:23:32.029 --> 00:23:35.130
was, like you said, somebody watching, waiting,

00:23:35.269 --> 00:23:37.769
and then saw the moment when the cousin turned

00:23:37.769 --> 00:23:41.250
around to grab the CD. And then took the opportunity

00:23:41.250 --> 00:23:46.210
to confront Josh when he was by himself. Or,

00:23:46.430 --> 00:23:49.769
you know, the other idea of him being hit by

00:23:49.769 --> 00:23:52.329
a car. It's like, okay, then a car just passes

00:23:52.329 --> 00:23:55.390
by momentarily in that moment and hits him on

00:23:55.390 --> 00:23:58.150
accident and doesn't stop. The timing of it is

00:23:58.150 --> 00:24:03.089
so, like, it's so small when his cousin is not

00:24:03.089 --> 00:24:05.549
there. And nobody heard anything. You know, the

00:24:05.549 --> 00:24:10.250
Andrews. house is right there from my understanding

00:24:10.250 --> 00:24:13.910
it seems like Joshua was in the Andrews yard

00:24:13.910 --> 00:24:15.890
and they didn't hear anything they were having

00:24:15.890 --> 00:24:19.369
dinner at the time and they didn't hear shouting

00:24:19.369 --> 00:24:23.410
a car screeching to a halt a car hitting you

00:24:23.410 --> 00:24:25.569
know they didn't hear anything until they heard

00:24:25.569 --> 00:24:28.890
the banging on the door so the timing is so slim

00:24:28.890 --> 00:24:31.670
and it makes you wonder if there is intention

00:24:31.670 --> 00:24:36.289
in it or if it's just like the timing was just

00:24:36.289 --> 00:24:39.990
like all and it just happened that way. Yeah,

00:24:40.049 --> 00:24:42.869
I think there's room for deep speculation on

00:24:42.869 --> 00:24:47.970
both ends of that, that because the timing is

00:24:47.970 --> 00:24:51.849
so, it's such a short timeline, it could absolutely

00:24:51.849 --> 00:24:55.509
be an accident or it could be a very pointed,

00:24:55.609 --> 00:24:59.230
coordinated attack on him. I think you summed

00:24:59.230 --> 00:25:02.799
it up kind of perfectly. That's what's so heartbreaking

00:25:02.799 --> 00:25:05.640
about this case is that it could so easily be

00:25:05.640 --> 00:25:08.720
one or the other or a multitude of different

00:25:08.720 --> 00:25:12.980
possibilities. I also just wanted to echo here.

00:25:13.039 --> 00:25:15.740
It was mentioned a couple times that they were

00:25:15.740 --> 00:25:21.099
just in his bedroom after he had passed away.

00:25:21.539 --> 00:25:24.779
There were a lot of teens or people just moving

00:25:24.779 --> 00:25:28.579
in and out of his room. There are a lot of moving

00:25:28.579 --> 00:25:34.339
parts. And that there were a lot of people spoken

00:25:34.339 --> 00:25:36.539
to about this case. A lot of people came forward

00:25:36.539 --> 00:25:39.640
and gave wrong information, whether it was intentional

00:25:39.640 --> 00:25:44.940
or not. And I just have to echo here that there's

00:25:44.940 --> 00:25:48.660
a lot of congestion for law enforcement to kind

00:25:48.660 --> 00:25:52.720
of sift through. And the sifting just becomes

00:25:52.720 --> 00:25:55.279
bigger and bigger and bigger as more time passes.

00:25:57.720 --> 00:26:00.279
I think it makes finding an answer in this case

00:26:00.279 --> 00:26:04.799
all that much more difficult. It does, for sure.

00:26:05.440 --> 00:26:08.099
The time passing, you know, it takes them a while

00:26:08.099 --> 00:26:11.259
to go through his room, which that to me was

00:26:11.259 --> 00:26:14.700
surprising that it took over a week for police

00:26:14.700 --> 00:26:17.259
to go through his room just to look for evidence

00:26:17.259 --> 00:26:20.259
and to take his computer. I think today police

00:26:20.259 --> 00:26:22.900
would take, you know, electronics first thing,

00:26:22.920 --> 00:26:28.920
but they waited for a week. His family can't

00:26:28.920 --> 00:26:31.180
help but think, did something go missing during

00:26:31.180 --> 00:26:32.900
that time that could have helped solve this case?

00:26:33.799 --> 00:26:36.079
Yeah, there's just a lot to move through. And

00:26:36.079 --> 00:26:40.519
then there's also the witnesses who saw the composite

00:26:40.519 --> 00:26:43.359
sketch that we'll have up on our Instagram, who

00:26:43.359 --> 00:26:45.380
saw that man running away from the scene about

00:26:45.380 --> 00:26:49.079
the same time that Joshua was found. So it's

00:26:49.079 --> 00:26:51.079
like, what came of that? Did they ever find that

00:26:51.079 --> 00:26:53.700
person? Did they talk to him? Like, who was that?

00:26:55.359 --> 00:26:59.859
That was my very last question. It kind of shocked

00:26:59.859 --> 00:27:02.519
me that it came at the end that there was someone

00:27:02.519 --> 00:27:06.519
who was possibly a suspect or a witness and in

00:27:06.519 --> 00:27:11.420
very bright clothing. I specifically took note

00:27:11.420 --> 00:27:13.079
of that because if you were in bright clothing,

00:27:13.160 --> 00:27:15.640
to me, it would seem like you were there accidentally

00:27:15.640 --> 00:27:21.210
or forced to be there. A lot of speculative motions

00:27:21.210 --> 00:27:24.710
in my head started going once I heard that. And

00:27:24.710 --> 00:27:28.990
his mom summed it up. I mean, it's heartbreaking,

00:27:29.230 --> 00:27:33.410
but beautifully of. I just want to know what

00:27:33.410 --> 00:27:38.029
happened. It's of course, you know, I would imagine

00:27:38.029 --> 00:27:40.210
she wants her son back, but like it seemed like

00:27:40.210 --> 00:27:43.630
even moving past that. I just want to know what

00:27:43.630 --> 00:27:48.380
happened in those final minutes. I could not

00:27:48.380 --> 00:27:52.700
echo her more. I think this case is solvable,

00:27:52.880 --> 00:27:56.519
especially now with technological advancement.

00:27:56.740 --> 00:28:00.460
I'm hoping that there are records we can comb

00:28:00.460 --> 00:28:04.779
through that uncover something here. What his

00:28:04.779 --> 00:28:08.359
mom said was perfect. It all ends the same with

00:28:08.359 --> 00:28:12.119
Joshua being gone and her and his family just

00:28:12.119 --> 00:28:14.859
wanting to know what happened to him. Whether

00:28:14.859 --> 00:28:19.480
this is... an intentional act or like an accidental

00:28:19.480 --> 00:28:22.779
hit and run whatever the case is it's a crime

00:28:22.779 --> 00:28:25.799
still happened here and a 16 year old was still

00:28:25.799 --> 00:28:32.059
left for dead and that is a crime and joshua's

00:28:32.059 --> 00:28:35.480
family his parents his cousins his sister they

00:28:35.480 --> 00:28:38.279
all deserve to know what happened to him and

00:28:38.279 --> 00:28:40.539
they they want to know those answers and i agree

00:28:40.539 --> 00:28:44.859
i think this case is solvable i hope that Someone

00:28:44.859 --> 00:28:47.200
comes forward with information that's been maybe

00:28:47.200 --> 00:28:50.599
sitting on them for years. To be able to give

00:28:50.599 --> 00:28:52.519
the family the answers that they are looking

00:28:52.519 --> 00:28:56.279
for, I think would be very healing. But again,

00:28:56.440 --> 00:28:58.640
if you know anything about the murder of Joshua

00:28:58.640 --> 00:29:03.079
Davis in January of 2004, please call the Garner

00:29:03.079 --> 00:29:10.059
Police Department at 919 -773 -6070. As always,

00:29:10.140 --> 00:29:13.720
I will be providing the graphics for Joshua's

00:29:13.720 --> 00:29:19.619
case. We will have a picture of him and the suspect

00:29:19.619 --> 00:29:22.500
sketch that Ali described at the end of the

00:29:22.500 --> 00:29:26.359
timeline. And you can find those graphics at
